On August 28, 2007, Governor Eliot Spitzer signed into law our Prior Service bill, which will grant credit for prior service in many titles so that the prior time will now be computed towards the minimum eligibility period for service retirement.
The effect of the law is that FDNY members will now receive full service credit as up-front time in the FDNY Retirement System for prior service in the uniformed service of a police, fire, corrections or sanitation department of the City of New York, or any agency or political subdivision or either; as a peace officer pursuant to Section 2.10 of the New York Criminal Procedure Law; as a member of the New York State Policemen’s or Firemen’s Retirement System; and/or in the title of sheriff, marshal, district attorney investigator or other position designated in the complete list of covered titles listed below.
Those members who previously transferred credit, or purchased time under such titles under pre-1999 buybacks, that resulted in non-uniformed service time credit, can now have that time credited as up-front (equated date) service. The effect will be that your entry into the FDNY will be at a younger age, so while your age decreases your rate will increase, but you’ll pay more for a lesser period of time, so in most cases you’ll receive money back. To begin the process you need to write a letter to the FDNY Pension Bureau requesting that your prior service time be credited as up-front time. With that you will receive a new equated date of appointment. Also, your time must be continuous without a break in service from the time of your date of leaving prior service and entering the FDNY for city service. Mail your letter requesting that the NYC Fire Department Pension Unit convert your prior non-uniform time to uniformed time under the new law. Address letters to:
