Medical Leave Update

At the present time the Medical Officer's driver is not permitted to grant Medical Leave. If the MO's driver grants you the remainder of the tour, and you want to be placed on Medical Leave, demand to speak with the MO. The MO is the only one who may grant Medical Leave. This issue will be on the agenda for the next Labor Management Meeting.

Labor Management -The following issues are currently being pursued by the Committee and the UFOA attorneys:

  • Step III Grievance - BC Gabriel's lift - After an initial meeting was held, an unfavorable decision on the Step III Grievance was received.
  • Haz-Mat 3 Addendum - The administration of injectable antidotes by CPC units - An objection to this policy has been filed. The UFOA is seeking to have all the Officers in a CPC unit to be CFR-D certified.
  • AUC 338; Joint Facilities Policy Guidelines - A meeting was held in conjunction with the UFA and the Department on March 7 th . The meeting established that the UFOA and UFA were opposed to the document as written. The UFOA and UFA demanded all concerned unions (including EMS unions) to be present at any meeting regarding this policy. The Unions reminded the Department that an Improper Practice has been filed and that this discussion would be more appropriate after a decision is rendered.
  • Safety Bulletin # 7 - Various changes and the requirement to have Fire Officers file the PCR, CD-72, CD-73, and MDX-3 via compute r - A pilot program is planned for Batts. 21, 22, and 23. A meeting is scheduled for April 4 th .

SFM Issues

The UFOA recently learned that the FDNY continues to use Supervising Fire Marshals to perform the duties of Administrative Fire Marshals. The UFOA won an arbitration award in 2004, stating that, “Supervision by SFM's should be confined to their squads,” and “assigning them to perform the duties of the Administrative Fire Marshal is improper and shall be discontinued”. We also went to court in order to enforce the award. On Monday, March 6 th , the UFOA sent a letter to all Supervising Fire Marshals requesting they decline such an assignment. A letter was sent to the 3 SFM's who are working as Administrative Fire Marshals asking them to resign their current assignment and return to a line position as a Supervising Fire Marshal. Our next step is to hold the Department in contempt for non compliance.

Fire Patrol

We have been in constant communication with Fire Patrol, Local I-26 President, James Nunez. A meeting is scheduled next week with Local I-26, UFA, UFOA, IAFF, and the NY Board of Fire Underwriters. The UFOA is committed to Local I-26 in their continuing efforts to keep the NY Fire Patrol open.

Promotional Exam - Captain

The Department of Citywide Administrative Service (DCAS) plans to administer the Promotion to Captain (Fire) Exam No. 5534, on June 10, 2006. MDA Week

As of this week, over $32,000 has been received by the MDA as a result of the UFOA/UFA's “MDA Week”. If your firehouse has not sent in a check, please do so immediately to MDA, PO Box 3178, Grand Central Station, New York, NY 10163. The UFOA would like to extend their thanks to all members who participated.

Heroes Stamp Act

As a result of the Federal 9/11 Heroes Stamp Act of 2001, the United States Postal Service (USPS) sold a postage stamp for a value greater than that of a regular first class stamp in order to raise funds to be distributed to families of emergency relief personnel killed or permanently physically disabled while serving in the line of duty in connection with the terrorist attacks against the United States on September 11, 2001.

FEMA is the Federal Agency responsible for distributing the funds raised. Additional information regarding the program and the application may be obtained at http://usfa.fema.gov/heroesstamp/ . The application deadline is 5 pm on April 3, 2006. If after reviewing the guidelines you believe that you qualify for the program and wish to apply, then you should submit an application. Your employer is required to verify certain parts of the application. Please note that we require the signature on page 4 to be notarized before completing the employer verification section.

All families who suffered a death on September 11, 2001 should send pages 3 and 4 of the application to the Family Assistance Unit, Room 8S-11, 9 MetroTech Center, Brooklyn NY 11201 and direct questions to Claire Jensen or Evelyn Tesoriero at 718-999-1473. All other applicants should submit pages 3 and 4 of the application to the FDNY, 9 MetroTech Center, Room 8N-5, Attn: Alex Fisher, Brooklyn, NY 11201, telephone: 718-999-2945/1428 .

These pages will be returned to all applicants so that they may submit a complete package to FEMA. Please note that if applicants do not receive the pages back from the FDNY by March 15, 2006, applicants should submit the incomplete package to FEMA with a note indicating that the FDNY is still in the process of completing the forms. FEMA will accept the application and FDNY will return the forms as soon as possible to the applicant.

Memorial Mass

On Tuesday, March 28, 2006 at 10:00am, E-24/L-5/B-2 will hold a memorial mass honoring the memory of Captain John Drennan, L-5, FF James Young, E-24, and FF Christopher Siedenberg, E-24, who made the supreme sacrifice on March 24, 1994. The mass will take place at St. Anthony's RC Church, located at Sullivan and West Houston Streets, Manhattan.

Memorial Service

A Memorial Service will be held on Tuesday, March 21, 2006 at 10:00am at St. Malachy's RC Church, 129 Van Siclen Avenue, Brooklyn, to honor the memory of: Captain John Dunne, L-175, Captain Eric Dailey, L-175, Lt. Robert Dolney, E-332, Lt. James Blackmore, E-332, FF Nicholas Marzelli, L-175, and FF Theodore Wieczorek, L-175.

AFL-CIO Support

Governor Pataki's budget proposal is promising $16 billion dollars in reckless tax cuts mostly for big corporations and the super rich while forcing devastating cuts in health care funding, public education and community services. Our members will suffer, so we must ACT NOW! Join the UFOA and the New York State AFL-CIO in helping to communicate this issue to all union members. Fliers are available at tonight's meeting.

Notice of Participation in the World Trade Center Rescue, Recovery or Clean-Up Operations

If you have not received your affidavit from the FDNY and you may qualify for the provisions of the WTC Bill, please call 718-999-7041 or 718-999-0148. The form must be completed, notarized and filed with the Fire Department Pension Fund, Subchapter II by June 14, 2007. It is highly recommended that you send this form by Certified Mail with Return Receipt Requested, as verification of filing and keep a copy of the form for your records. There is a copy of this Affidavit and the instructions on our website. If you are unsure if you qualify, you should still fill out and submit the form.

Legal Proceedings

VSF Action - The retirees' filed their brief on appeal, and the City and unions are responding.

1127 Federal Litigation - Judge Barbara Jones has made no determination on our litigation.

 

Administrative Proceedings

Battalion and Division Commander IP - Further proceedings to be scheduled.

Administrative Fire Marshals - No change.

EMS IP - We filed an improper practice charge that the assignment of supervisory responsibilities over EMS staff is a fundamental change in the job descriptions of bargaining unit positions, on which the City is required to negotiate. The City has answered, and we are preparing our reply.

Meal Period IP - We have filed an improper practice charge that the change in meal period policy requiring responses to CFR-D incidents cannot be imposed unilaterally. The City responded, and we are preparing our reply. This charge will likely be deferred until the arbitration is completed. (See below.)

Meal Period Arbitration - We have filed an arbitration demand, claiming that the change in meal period policy also violates the collective bargaining agreement. Hearings have been scheduled for April 26, 2006.

Off-Chart Assignment Arbitration - We have filed an arbitration demand over the assignment of certain members off-the-chart to non-emergent duties (e.g., training). The City has obtained additional time from the Office of Collective Bargaining to challenge the arbitrability of the grievance.

Comp Time Arbitration - We have filed an arbitration demand over the failure of the Fire Department to establish any policy or means permitting members to use their comp time on a timely and equitable basis. The City has responded by challenging the arbitrability of the grievance to OCB. We will respond to OCB in the next month.
